These Terms and Conditions (“Terms”) govern your use of our website choicecarehh.com and our home health care services, including skilled nursing, physical therapy, occupational therapy, speech and language pathology, medical social work, and home health aide support (collectively, the “Services”). By accessing our website, contacting us, or receiving our Services, you agree to be bound by these Terms. If you do not agree, please do not use our website or Services.
1. Acceptance of Terms
By using our website or Services, you confirm that you are at least 18 years old or have the consent of a legal guardian, and you have the capacity to enter into a binding agreement. If you are arranging Services on behalf of another individual (e.g., a family member), you represent that you have the authority to act on their behalf and bind them to these Terms.
2. Use of Services
You agree to use our website and Services in accordance with these Terms, applicable laws, and regulations, including the Health Insurance Portability and Accountability Act (HIPAA) and Medicare guidelines. You are responsible for:
- Providing accurate and complete information, including personal, health, and insurance details, when requesting or receiving Services.
- Cooperating with our staff, including allowing safe access to your home for care visits and following prescribed care plans.
- Notifying us promptly of any changes to your health condition, insurance coverage, or contact information.
- Not using our website or Services for unlawful or unauthorized purposes, including submitting false information or interfering with our systems.
3. Home Health Care Services
We provide Medicare-certified and ACHC-accredited home health care Services, including but not limited to:
- Skilled Nursing: Medical care by licensed nurses, such as wound care or medication management.
- Therapies: Physical, occupational, and speech therapy to support recovery and independence.
- Medical Social Work: Assistance with community resources and emotional support.
- Home Health Aide: Help with daily activities like bathing and grooming.
Services are provided based on a physician’s referral, your care plan, and insurance approval. We reserve the right to modify or discontinue Services as required by medical necessity, insurance coverage, or regulatory changes, with notice where feasible. Specific terms, including visit frequency and duration, will be outlined in your care agreement.
4. Insurance and Payments
Our Services are primarily billed through Medicare, Medicaid, or private insurance, subject to eligibility and approval. You agree to:
- Provide accurate insurance information and authorize us to verify coverage and submit claims on your behalf.
- Pay any copayments, deductibles, or non-covered services as required by your insurance plan or as outlined in your care agreement.
- Notify us of any changes to your insurance coverage within 48 hours.
If Services are not covered by insurance, we will provide a cost estimate before proceeding, and you will be responsible for payment. Billing disputes must be reported within 7 days of receiving a statement. Non-payment may result in suspension of Services, subject to applicable laws.
5. Intellectual Property
All content on our website, including text, logos, images, and care resources, is the property of ChoiceCare Home Health or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without prior written consent. Any materials provided as part of our Services (e.g., care guides) are for your personal use only and may not be shared or repurposed.
6. Confidentiality and HIPAA Compliance
We are committed to protecting your personal and health information in compliance with HIPAA. Our use and disclosure of your protected health information (PHI) are detailed in our Privacy Policy and HIPAA Notice of Privacy Practices, provided to patients at the start of care. You agree to provide only accurate and necessary information and to respect the confidentiality of our staff and processes.
7. Termination of Services
We may suspend or terminate Services if you violate these Terms, fail to meet insurance or payment obligations, or if continued care is deemed unsafe or medically inappropriate, in accordance with Medicare and ACHC guidelines. You may request termination of Services at any time, subject to your care plan and any legal or insurance requirements. Upon termination, your access to Services will cease, but obligations such as payment for rendered Services and confidentiality will survive.
8. Limitation of Liability
To the fullest extent permitted by law, ChoiceCare Home Health, its affiliates, and their respective officers, directors, and employees will not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of our website or Services, including but not limited to loss of health outcomes or financial losses. Our total liability for any claim related to these Terms or Services will not exceed the amount paid by you (or your insurer) for the specific Service giving rise to the claim.
Our Services are provided with professional care but are not guaranteed to achieve specific health outcomes. We do not warrant that our website will be uninterrupted, error-free, or free from harmful components.
9. Indemnification
You agree to indemnify and hold harmless ChoiceCare Home Health, its affiliates, and their respective officers, directors, and employees from any claims, damages, or losses arising from your violation of these Terms, misuse of our Services, or provision of inaccurate information that impacts care or billing.
10. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Illinois, without regard to conflict of law principles. Any disputes arising from these Terms or our Services will be resolved through good-faith negotiation. If negotiation fails, disputes will be submitted to the exclusive jurisdiction of the courts in Cook County, Illinois. For HIPAA-related concerns, you may also contact the U.S. Department of Health and Human Services Office for Civil Rights.
11. Changes to These Terms
We may update these Terms to reflect changes in our Services, legal requirements, or operational practices. We will notify you of significant changes by posting the updated Terms on our website with a revised “Last Updated” date or by direct communication. Your continued use of our website or Services after such changes constitutes acceptance of the updated Terms.
